Terms of Use

1. License

Your use of the app is licensed, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), which is incorporated into these Terms. Where these Terms provide additional app-specific provisions, they supplement the Standard EULA.

2. Health and Fitness Disclaimer

The app provides fitness programming, exercise instruction, and training recommendations for general informational and educational purposes only. It is not medical advice, and it is not a substitute for the advice of a physician or other qualified health provider. Dr. Gains does not diagnose, treat, or cure any medical condition.

Consult your physician before beginning this or any exercise program — especially if you have a medical condition, are pregnant, or have any concern about your fitness to exercise. Some training styles offered in the app, such as blood flow restriction (BFR) training, carry additional risks and contraindications and should not be performed without understanding them.

Exercise involves inherent risk of injury. You are responsible for exercising within your limits and using proper form and appropriate equipment. To the maximum extent permitted by law, you voluntarily assume all risk arising from your use of the app’s programs and content.

3. Accounts

You must be at least 18 years old to create an account. You are responsible for activity on your account and for keeping your sign-in method secure. You can delete your account at any time in the app (Profile → Delete my account), which deletes your personal information and training data.

4. Subscriptions and Purchases

The app offers auto-renewable subscriptions and one-time program purchases, processed by Apple through your App Store account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel them in your device’s App Store subscription settings. Deleting your account or the app does not cancel a subscription. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Refunds are handled by Apple under App Store policies.

5. Content and Intellectual Property

All app content — training programs, videos, text, graphics, and software — is owned by or licensed to Kamalu Enterprises DBA Dr. Gains and is protected by intellectual property laws. Your subscription or purchase grants you a personal, non-transferable, non-commercial right to access the content within the app. You may not copy, redistribute, publicly display, resell, or create derivative works from it.

6. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to the app, other accounts, or our systems
• Reverse engineer, decompile, or tamper with the app except as permitted by law
• Interfere with or disrupt the operation of the app or its services

7. Disclaimer of Warranties

The app is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that results from any program will meet your goals.

8. Limitation of Liability

To the maximum extent permitted by law, Kamalu Enterprises DBA Dr. Gains will not be liable for any indirect, incidental, special, consequential, or punitive damages — or for personal injury arising from your participation in any exercise program — arising out of or related to your use of the app. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.

9. Termination

We may suspend or terminate access to the app for violation of these Terms. You may stop using the app and delete your account at any time. Provisions that by their nature should survive termination (including Sections 2, 5, 7, and 8) survive.

10. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the “Effective Date” above. Your continued use of the app after any changes means you accept the revised Terms.
